Epic Games once again faced a lawsuit over an emote used in Fortnite. In particular, in 2018-2019, various lawsuits were filed against Fortnite. 2 Milly, Alfonso Ribeiro and even the Orange Shirt Kid’s mother had demanded compensation from Epic Games for using dance moves in the game without permission.
This time, the subject of the lawsuit is It;s Complicated emote; In the move, Charlie Puth allegedly copied dance choreography created by Kyle Hanagami in his 2017 song How Long without permission, the lawsuit alleges.
Epic Games began securing the business after previous lawsuits, and went on to buy the rights by paying royalties for the dance moves it would use. However, Hanagami says he has not been offered any use of his work.
“Epic often approaches young and/or less experienced artists who shine on file media platforms like TikTok and licenses their choreography at no cost. Hanagami, an experienced businessman and renowned choreographer, is aware of the value of his choreography and has not been applied for a license by Epic.”
Hanagami’s lawyer, David Hecht, says the case is different from its predecessors because hanagami’s choreography is proprietary.
“Epic profits unfairly from my client’s work. It is completely unfair that Epic;in Kyle sells his proprietary choreography in the Fortnite Store without his knowledge and permission.”
